The original DOTA team created DOTA as a Mod to Blizzard's Warcraft III. It was a Mod, third party software. Valve was perfectly fine with hiring the DOTA team and purchasing the DOTA trademark. At the time, they were a third party mod team and not officially ascociated with Blizzard at all. Now Blizzard is foreseeing Valve making a superstar of DOTA2 and now they are crying about it.
