In the case where it is a petty argument, sure, i.e. atheists are bad because Hitler was an atheist. If you're talking about torturing people for science it is definitely a valid argument. That doesn't mean we should make it a mandatory thing to cut off people's heads and sew them back on again. It leaves a huge mess, it is traumatizing for the witnesses, it can easily misfire by not properly cutting through the bone and it is known that the decapitated head stays fully aware for about 7 seconds. The current lethal injections are probably the best thing we got right now, apart from maybe carbondioxide poisoning (although I can see how that could misfire easily). I might be biased now, but I say if you have a death penalty at least make it humane. People get the death penalty for things we would consider inhumane, and punishing them by dropping to the same level as them seems kind of... medieval. Destruction of the Thalamus, I think: that's where people aim for when they shoot themselves in the back of the palate.
